An independent operator/contractor must have to have mandatory coverage with WSIB; however, in case of an accident WSIB can decide your company is responsible for the individual and deem him or her your employee. To minimize your exposure to WSIB costs/penalties confirm with WSIB the status of the independent operator before you hire them, by having you and the independent operator complete a WSIB questionnaire form, both signing it and sending it to WSIB for a decision.
